This End User License Agreement ("EULA") governs your use of the Remsee mobile and desktop applications ("Licensed Application") provided by Numtrend Co., Ltd. ("Numtrend", "we", "us"). The Licensed Application is licensed, not sold, to you. This EULA supplements, and is in addition to, the Remsee Terms of Service, Privacy Policy, and other policies, which are incorporated by reference. Where this EULA conflicts with the App Store or Google Play terms for the licensing of the Licensed Application, those store terms control to the extent required.
1. License Grant
- Subject to this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Licensed Application for your personal, non-commercial use on a device that you own or control, as permitted by the Usage Rules of the applicable app store.
- For Apple App Store downloads, the license is limited to use on any Apple-branded products that you own or control and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
2. Scope and Restrictions
You may not, except as permitted by Applicable Law or the applicable store terms:
- Copy, modify, translate, or create derivative works of the Licensed Application.
- Reverse engineer, decompile, or disassemble the Licensed Application, or attempt to derive its source code.
- Rent, lease, lend, sell, redistribute, or sublicense the Licensed Application.
- Remove, alter, or obscure any proprietary notices.
- Use the Licensed Application to breach the Acceptable Use Policy, Community Guidelines, or Applicable Law.
3. In-App Purchases and RSM Credits
- Subscriptions (Plus, Pro), RSM Credits, post boosts, and other digital items are sold as in-app purchases processed by the applicable app store.
- RSM Credits are an in-app utility credit governed by the RSM Credits Policy and the Terms of Service. They are non-refundable and non-redeemable for cash, have no value outside the Licensed Application, and may be forfeited on policy violation, in each case to the extent permitted by Applicable Law.
- Auto-renewing subscriptions renew unless cancelled through the store before the renewal date, as described in the Subscription Policy.
4. Maintenance and Support
Numtrend is solely responsible for providing any maintenance and support for the Licensed Application, as specified in this EULA or required by Applicable Law. The app store provider (e.g., Apple, Google) has no obligation to furnish any maintenance or support services for the Licensed Application.
5. Warranty
- To the maximum extent permitted by Applicable Law, the Licensed Application is provided "as is" and "as available" without warranty of any kind.
- For Apple App Store downloads: in the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by Applicable Law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Numtrend's sole responsibility.
6. Product Claims
Numtrend, not the app store provider, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including: (a) product liability claims; (b) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, in each case to the extent not caused by the app store provider.
7. Intellectual Property and Infringement Claims
The Licensed Application and all related intellectual property are owned by Numtrend Co., Ltd. or its licensors. In the event of any third-party claim that the Licensed Application or your use of it infringes that third party's intellectual property rights, Numtrend, not the app store provider, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by this EULA and Applicable Law.
8. Legal Compliance
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties, and you will otherwise comply with applicable export, sanctions, and trade laws.
9. Third-Party Terms
You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless data service agreement, and the terms of app stores, payment providers, and Travel Partners).
10. Third-Party Beneficiary
You acknowledge and agree that the app store provider, and its subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, the app store provider will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
11. Termination
This license is effective until terminated by you or Numtrend. Your rights under this EULA terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use and delete all copies of the Licensed Application. Sections that by their nature should survive termination will survive.
12. Limitation of Liability
To the fullest extent permitted by Applicable Law, the limitation of liability and disclaimers in the Terms of Service apply to this EULA, including the liability cap of the greater of the total amount you paid to Remsee in the 12 months before the claim or USD 100. Nothing in this EULA limits liability that cannot legally be limited.

14. Governing Law
This EULA is governed by the laws of the Kingdom of Thailand, with the courts of Bangkok having jurisdiction, unless mandatory consumer or app-store law provides otherwise.
